We answer that question and delve into the story behind it. <\/em><\/strong><\/p>\n<p><strong>Pepsi point<\/strong> The condition formally known as<strong> <a href=\"https:\/\/en.wikipedia.org\/wiki\/Leonard_v._Pepsico,_Inc.\">Leonard v. PepsiCo Inc<\/a><\/strong>.  88 F. Supp.  2d 116, (SDNY 1999), Fact Sheet 210 F.3d 88 (2d Cir. 2000), held in the Southern District of New York in 1999. Undergraduate Student, <strong>John Leonard<\/strong>try to buy a <strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Harrier_jump_jet\">Harrier Gate<\/a><\/strong>    with <strong>Pepsi Points<\/strong>.  This consists of a marketing campaign that fails to use a disclaimer.  This omission was, according to Leonard, a legitimate oversight.  In his opinion, he could buy the military weapon for 7,000,000.<\/p>\n<h2><strong>How much is 7 million Pepsi points?<\/strong><\/h2>\n<p>You can earn Pepsi points by purchasing Pepsi products.  A young college student, John Leonard, had a plan to collect enough points to buy what the cola giant&#8217;s advertisement promised.  For 7,000,000 Pepsi points, you can buy a Harrier plane and land the thing on your school property.  Was this a joke?  I mean maybe.  However, Leonard took it seriously enough.<\/p>\n<p>Leonard created a business plan that included how much brown sugar to buy (I don&#8217;t think Clear Pepsi wasn&#8217;t a thing yet), where to store it, and even who to hire. <strong>However, the total he came up with was $4.3 million<\/strong>.  Leonard and his investor back off because they may fail to achieve their goal before the rules change or the contest ends.<\/p>\n<p>That&#8217;s when Leonard discovered that you could buy Pepsi Points for 10 cents each as long as you bought at least 15 points.  This brought the overhead and cost down to $700,000.  And that&#8217;s what Leonard and Hoffmann did.  They filled out the form, attached a check to it, pulled out their box, and then marked it with the words &#8220;Harrier Jet&#8221; to the right.<\/p>\n<h2><strong>What does John Leonard do for a living?<\/strong><\/h2>\n<p><strong>At the time of the Pepsi commercial, John Leonard was a college student<\/strong>.  Today, he is 48 years old and works as a park ranger in Talkeetna, Alaska.  He is currently married and has two children.<\/p>\n<h2><strong>What is Harriet&#8217;s plane?<\/strong><\/h2>\n<p><strong>The AV-8 Harrier II Jump Jet is a single-engine aircraft that forms the second generation of the Harrier family, and is capable of vertical or short take-off and landing.<\/strong> The Harrier Jet&#8217;s well-documented function is to attack and destroy surface and air targets, armed reconnaissance, air interception, offensive and defensive anti-aircraft warfare.<\/p>\n<\/p>\n<h2><strong>Has anyone brought a Harrier plane of Pepsi?<\/strong><\/h2>\n<p><strong>No, Pepsi refused to give Leonard and Hoffman the plane.<\/strong> They didn&#8217;t cash the check wisely and tried to provide the students with coupons for 2 free cases of Pepsi.  After trying to negotiate with the pair, a lawsuit was filed.  Unfortunately, the judge sided with the big business.  Under a (second) restatement of the contracts, the commercial did not constitute a legitimate offer.  It was not considered a reasonable offer because winning a multi-million dollar plane for $700,000 was &#8220;just puffing.&#8221;  The court ruled that this fell under the &#8220;fraud statute,&#8221; but state laws required a written agreement in advance.<\/p>\n<p>The kicker was the judge&#8217;s explanation that this was a commercial &#8220;joke&#8221; and since the &#8220;idea&#8221; of going to school in such a car is an &#8220;exaggerated teenage fantasy&#8221;.  Even they were cited, they understood this, schools do not provide landing places for aircraft, the attitude of a teenager was serious about landing such a car in a residential area, and the &#8220;young people&#8221; in commercials could never have landed such a car, let alone a car.
