That’s when Leonard discovered that you could buy Pepsi Points for 10 cents each as long as you bought at least 15 points. This brought the overhead and cost down to $700,000. And that’s what Leonard and Hoffmann did. They filled out the form, attached a check to it, pulled out their box, and then marked it with the words “Harrier Jet” to the right.

After trying to negotiate with the pair, a lawsuit was filed. Unfortunately, the judge sided with the big business. Under a (second) restatement of the contracts, the commercial did not constitute a legitimate offer. It was not considered a reasonable offer because winning a multi-million dollar plane for $700,000 was “just puffing.” The court ruled that this fell under the “fraud statute,” but state laws required a written agreement in advance.
The kicker was the judge’s explanation that this was a commercial “joke” and since the “idea” of going to school in such a car is an “exaggerated teenage fantasy”. Even they were cited, they understood this, schools do not provide landing places for aircraft, the attitude of a teenager was serious about landing such a car in a residential area, and the “young people” in commercials could never have landed such a car, let alone a car. The group appealed, but was upheld by the United States Court of Appeals in the Second Circuit.
